Vietnamese citizenship registration for a child born in Canada

A birth certificate is an important document in registering citizenship in the Citizenship Act of many countries. However, for many reasons, many people do not have Vietnamese citizenship because their parents skipped the birth registration procedure according to the law. This leads to a "disadvantage" in the legal rights and benefits that Vietnamese citizens are given from the perspective of the law, most commonly the right to own land use rights in Vietnam and the right to reside for a long term in the homeland if possessing Vietnamese passport.

The regulation on birth registration below is advised by Giang Le Notary office in Ottawa (Canada) for the following cases:

For children born in Canada whose parents are Vietnamese citizens

  1. Birth Certificate or Birth Extract application form;
  2. A certified true copy of the child's Canadian birth certificate (attached with the original for comparison).
  3. A certified true copy of the parent's marriage certificate (attached original for comparison).
  4. A certified true copy of the passport of the child's father and mother's passport. In case the child's father (or mother) is living in Vietnam or in another country (neither Vietnam nor Canada), please submit an additional declaration of the father that is stated in the child's birth certificate application form. If the child's father does not have Vietnamese nationality, you must submit an additional negotiation document between the parents about the child's citizenship.
  5. Biological child recognition form declared by the father (if necessary)

For those who were born and registered their birth in Vietnam before January 1, 2016, but lost an original household book

  1. A reissued birth certificate form witnessed by 2 witnesses
  2. Two (02) passport photos (taken within a month).
  3. A certified true copy of passport, ID card, Household registration book or valid alternative documents such as Record of Landing (attached with original for comparison).
  4. Two (02) copies of the authorization letter (with the authorizer's signature commissioned by the Notary and legalized pursuant to the law) which allow the authorized person to work with government authorities in Vietnam;

For people who were born and registered their birth in Vietnam and want to apply for a copy of their Birth Certificate:​

  1. An application form for a copy of a birth certificate
  2. 02 authorization letters allow the representative to carry out procedures to apply for a copy of the Birth Certificate.
  3. A certified true copy of passport and documents proving Vietnamese nationality (such as Identification card, household registration book...).

Note: Documents in a foreign language in the application must be translated into Vietnamese according to the law.

All documents used in the above submission shall require the applicant's signature to be commissioned by a Notary Public, and then undergo the authentication and legalization process to be valid in Vietnam.
